Terms & Conditions

All terms and conditions are listed below. Please read carefully. By signing (written or electronic),  you acknowledge that you have read, understand, and agree to be bound by these Terms &  Conditions. 

Parties 

For purposes of this Rental Agreement, the following terms shall have the meanings set forth  below: 

  • “Young’s Suncoast” or “Agent” means Young’s Suncoast Realty & Vacation Rentals, the  property management company acting solely as the exclusive and authorized rental and  management agent for the Owner.  
  • “Owner” means the legal owner(s) of the vacation rental property identified in this Rental  Agreement.  
  • “Guest” means the individual executing this Agreement, placing the reservation, and  assuming responsibility for all occupants, invitees, payments, damages, and obligations  arising under this Agreement.  
  • “Occupants” means all individuals authorized by the Guest to stay overnight at the Property  during the reservation period.  
  • “Invitees” means any person invited or permitted onto the Property by the Guest or any  Occupant, whether they stay overnight or not.  
  • “Property” or “Premises” means the vacation rental property identified in this Agreement,  including the dwelling and any areas or amenities made available for Guest use. 

1 – PAYMENT INFORMATION 

1.1 Payment Terms 

(a) Advanced Rent and Balance Due Policy  

Non-Refundable Prepayments: A non-refundable prepayment of $295 for condos, or $495 for  penthouses and houses, is due at the time of booking and is required to secure your reservation.  This prepayment is included in the total charges and will be applied to your final payment. If you are  reserving within 30 days of arrival for condos and 60 days of arrival for houses, the total charges are  due at the time of booking. Your prepayment will be applied to your reservation total.

Balance Due: In order to expedite your check-in, payments of all balances owed are due 30 days  before arrival for condos, and 60 days for houses. We will automatically charge the final payment to  the card on file on your balance due date.  

1-Month Reservations: A non-refundable prepayment of $295 is due at the time of booking and is  required to secure your reservation. This prepayment is included in the total charges and will be  applied to your final payment. The Balance Due payment date is 120 days prior to arrival. If you are  making a 1-month reservation within 120 days of arrival, full payment is due at the time of booking.  

2+ Month Reservations: A non-refundable prepayment of $295 is due at the time of booking and is  required to secure your reservation. This prepayment is included in the total charges and will be  applied to your final payment. 55% of the total amount is due 120 days prior to arrival with the  remaining balance due 30 days prior to arrival. If you make a reservation within 120 days of arrival,  full payment is due at the time of booking. 

(b) Alternate Credit Card 

If the Guest wishes to use a different credit card for the balance payment, the Guest must contact  our office in advance to make alternate arrangements. 

1.2 Spring Break & Special Event Payment Requirements 

(a) Spring Break and Special Event Policy 

During the Spring Break period of March 1 through April 30 of each year, in lieu of prepayment, all  guests must choose to either pay a refundable damage deposit or purchase a damage protection  plan. This policy will also apply during certain area events, such as, but not limited to music  festivals and concerts. 

(b) Damage Deposit Option 

Guests can pay a $500 damage deposit for condos or $1000 damage deposit for houses. This  deposit will be refunded to you after a post-departure inspection has been completed and there is  confirmation that no damages, violations, or unpaid charges exist.

(c) Damage Protection Insurance Option 

You can choose to purchase a Damage Protection Insurance Policy for $45. This protection plan  will cover up to $1,500 for any accidental damage that occurs in the property during your stay. This  fee is not refunded after departure. You can purchase this plan by calling our office. 

(d) Guest Responsibility for Damages 

Guest will be fully responsible for any Guest, Occupant, or Invitee-caused loss or damage to the  vacation property, including but not limited to undue cleaning, ejectment/eviction, service calls,  service charges, fines/assessments, repairs or replacements, and all applicable taxes. By written or  electronic execution of this agreement, the Guest authorizes Young’s Suncoast to charge the credit  card on file for all such charges. If the credit card is not valid, these issues will be addressed  directly with the Guest, including through legal counsel if necessary. 

1.3 Cancellation & Reservation Change Policy 

(a) Cancellation Policy 

Daily / Weekly Rentals: You may cancel your reservation 30 days or more prior to your arrival for  condos, or 60 days prior to arrival for houses, and all payments are refundable, except the non refundable pre-payment amount and the trip insurance premium, if purchased. If cancelling within  30 days of your arrival for condos, or within 60 days of arrival for houses, all monies paid will be  forfeited. Any changes to a reservation within those time frames will incur a $30 administrative  change fee. 

Monthly Rentals 

1-Month Reservations: You may cancel your reservation 120 days or more prior to your arrival and  all payments are refundable, except the non-refundable $295 prepayment and the trip insurance  premium, if purchased. If you cancel within 120 days of arrival, you will forfeit all monies paid.  There are no refunds for early departures. 

2+ Month Reservations: You may cancel your reservation 120 days or more prior to your arrival and  all payments made are refundable except the non-refundable $295 prepayment and trip insurance  premium, if purchased. There are no refunds for early departures. Any changes to your stay dates  made between 120 days and your arrival date will incur a $100 fee per bedroom. 

(b) Modification Policy 

Any modifications to a reservation, including changes to the property, arrival or departure dates, or  other booking details, shall not invalidate the Guest’s previously executed electronic rental  agreement. The agreement shall remain fully binding and apply to the updated reservation.

(c) No Refunds for Unused Occupancy 

No refunds, credits, or rate adjustments will be issued for unused occupancy resulting from late  arrivals, early departures, travel delays, inclement weather including hurricanes, tropical storms,  named storm events, or any other circumstances beyond Young’s Suncoast Vacation Rental’s  control.  

(d) Reservation Services / Liquidated Damages  

Guest acknowledges that Young’s Suncoast provides reservation services upon booking, including  securing and holding the property, removing it from availability, processing payments, providing  confirmations, and coordinating pre-arrival services. Guest further acknowledges that cancellation  fees, forfeited payments, and non-refundable pre-payments are agreed upon liquidated damages  and not a penalty, and that such amounts are reasonable due to administrative costs, lost booking  opportunities, and the difficulty of re-renting the property on short notice. Guest agrees not to  dispute these charges as “services not rendered” or for any similar reason. Guest further agrees to  contact Young’s Suncoast Vacation Rentals and provide a reasonable opportunity to resolve any  billing or reservation concerns before initiating a chargeback or payment dispute with their financial  institution. 

1.4 Chargebacks / Disputed Charges  

Guest agrees not to dispute, reverse, or initiate any chargeback with any credit card issuer or  payment provider for charges properly assessed under this Agreement, including but not limited to  rent, deposits, cancellation fees, taxes, administrative fees, damages, cleaning charges, fines, and  any other amounts due. Guest acknowledges that cancellation penalties and forfeited payments  are valid liquidated damages and not a penalty, as outlined in Article 1, section 1.3(d) of this  Agreement. Any chargeback initiated in violation of this Agreement shall be considered a material  breach of contract.  

Guest agrees that Young’s Suncoast reserves the right to dispute any chargeback with supporting  documentation, including this signed Rental Agreement, payment authorization, reservation  confirmation and other reservation records, communications, maintenance records, cancellation  policy, check-in instructions, and any other relevant documentation to the bank/issuer as evidence.  Young’s Suncoast reserves the right to pursue any additional legal remedies available for recovery  of the amounts owed, including applicable fees and costs permitted by law. Guests shall remain  responsible for all amounts due, including chargeback fees, collection costs, and reasonable  attorney’s fees. 

2 – INSURANCE & LIABILITY 

2.1 Travel Insurance 

Young’s Suncoast offers optional travel insurance through Generali to help protect Guest against  unforeseen circumstances. The cost of standard travel insurance is 7.95% of the total trip cost.  Coverage is available at the time the rental deposit is paid or when your final reservation payment is

made. Insurance coverage becomes effective only upon receipt of the insurance premium. Travel  Insurance can provide coverage for:  

  • Trip Cancellation  
  • Trip Delay  
  • Loss or damage to baggage during a planned, covered trip 
  • Accident, Illness, Injury, or Death during a planned, covered trip 

Insurance premiums are non-refundable after ten (10) days of purchase. Travel Insurance will not  be available for purchase after your final reservation payment is made. For added peace of mind,  we encourage you to purchase Travel Insurance at the time of booking. NO REFUNDS shall be  issued within the cancellation window of the reservation start date for any reason, including  hurricanes or tropical storm events. 

2.2 Accidental Damage Protection Insurance Plan  

As a part of your stay, you may purchase an optional Vacation Rental Damage Protection plan  policy through Generali for a nominal fee of $45. This plan is designed to cover unintentional  damage to the rental unit interior that occurs during your stay provided they are disclosed to  management prior to check-out. If purchased, the policy will pay a maximum benefit of $1,500. Any  damages that exceed $1,500 or are not covered under the plan will be the responsibility of the  Guest and will be charged to the credit card on file. If, during your stay at one of our rental  properties, an insured person causes any damage to real or personal property of the unit as a result  of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or  replacement of such property up to a maximum benefit of $1,500. Certain terms and conditions  apply. 

The Vacation Rental Damage Protection can be purchased up to 24 hours before your arrival date.  By submitting payment for this plan, you authorize and request Customized Services  Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directly Young’s  Suncoast any amount payable under the terms and conditions of the Vacation Rental Damage.  

Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage  Insurance Policy

If the Guest does not purchase the optional Damage Protection Plan, the Guest will be fully  responsible for all damage that occurs to the property, pursuant to Article 1, Section 1.2(d)

2.3 Acts of Nature & Events Beyond Young’s Suncoast’s Control Young’s Suncoast cannot be held responsible for circumstances beyond our control, including but  not limited to excessive noise from construction in the building or in the vicinity of the rented  property, noise from public or private events, excessive noise from neighboring properties; traffic

delays or road closures; interruption of internet, cellular services or other utilities, unexpected  appliance or equipment failures; wildfires, smoke or other air quality conditions; any weather related interruptions, hurricanes or other tropical weather events; or government actions or  emergency orders. No refunds shall be issued within the cancellation window of the reservation  start date for any reason, including hurricanes or tropical storm events.  

2.4 Property Substitutions 

We reserve the right to substitute comparable accommodation without notice or liability should the  reserved property be out of order or not available for any reason. If comparable accommodation is  not available, the Guest will have the option of selecting from available properties at the published  rate or receiving a complete refund of the reservation deposit and all prepaid rent. 

3 – ARRIVAL / DEPARTURE & OCCUPANCY 

3.1 Arrival 

Check-in begins at 4:00 PM. While every effort is made to have the vacation rental ready on time,  check-in may be delayed past 4:00 PM due to unforeseen circumstances.  

Sometimes, early check-in may be available for an additional fee. You will be notified the day before  your arrival if the property you rented is available for an early check-in. During peak season  (Memorial Day through Labor Day), early check-in may not always be available. No exceptions. 

3.2 Departure  

Check-out is 10:00 AM. Guests who remain on the property past 10:00 AM without prior written  approval will be charged for an additional day. Prompt departure is appreciated so the property can  be prepared for incoming guests.  

Prior to departure, all garbage must be removed and disposed of in available trash chutes,  dumpsters, or outdoor trash cans. All used dishes (including utensils, pots, and pans) must be  cleaned and returned to their original location. Please do not leave dirty towels and linens in a pile.  All windows and doors must be closed and locked. 

3.3 Occupancy Requirements 

Occupancy is limited to the stated sleeping capacity as indicated by Young’s Suncoast Vacation  Rentals, including children. Exceptions may be made only for children under the age of two (2). The  individual placing the reservation must meet the minimum age requirements for the rented  property, must be the authorized holder of the credit or debit card used for payment, and must be  the same individual checking in. This individual shall be designated as the “Guest.”

All correspondence regarding reservations, cancellations, and damage policies will be conducted  exclusively with the Guest. 

The Guest must occupy the property for the full term of the reservation and is responsible for the  conduct of all Occupants and Invitees at all times. Any reservation obtained under false pretense  may result in immediate eviction and forfeiture of all payments made. 

Most properties have a minimum age requirement of twenty-five (25) years old to rent. We have a  small selection of properties that allow bookings for twenty-one or more (21+) years of age. Check  with our office to confirm the minimum age requirement of the property you have rented. Underage  individuals who do not meet the property’s minimum age requirements are not permitted to  rent. Guests younger than the minimum age requirement must always have direct adult supervision when on rental premises. No loud parties, loud gatherings or illegal activities are allowed.  

Guest agrees that this occupancy timeframe is a temporary, short-term stay, determined by the  arrival date and departure date you chose during the booking process. Failure to depart on your  specified departure date and time will result in additional nightly rates being charged to your card  on file and possible eviction. 

3.4 Spring Break & Special Event Requirements 

During the spring break period of March 1 through April 30 of each year, the person booking the  reservation must meet the minimum age requirement and must physically check in at our office  with your government issued ID present. Absolutely no property will be rented to vacationing  students who do not meet the minimum age requirements. This policy will also apply during certain  area events, such as, but not limited to music festivals and concerts. 

3.5 Keys  

Most properties offer keyless entry by electronic codes, but a few properties still require the use of  physical hard keys. 

If the rental requires hard keys (physical key or key card) for access, key(s) must be picked up from  and returned to the Young’s Suncoast Vacation Rental Corporate Office unless you are informed  otherwise. A replacement fee will be assessed for any key(s) not returned. Replacement fees vary  by property.  

If a key is lost, stolen, locked inside the unit, and a Young’s Suncoast Vacation Rental  representative is required to provide access, a minimum trip service fee of $25 during normal  business hours and $50 after 5:00 PM will be charged immediately to the Guest’s account. The  Guest is responsible for any additional costs incurred if a locksmith is required.

In the case of a lost or stolen key, any replacement costs for the key will be charged immediately to  the Guest’s account.  

3.6 Parking 

Condominium and Subdivision Homeowner Associations (HOA) set parking limits on their  property’s parking lots, not Young’s Suncoast Vacation Rentals (the Rental Company). Most  associations restrict parking to one (1) vehicle for 1-bedroom rentals and two (2) vehicles for 2- or more bedroom rentals. However, some HOA rules may restrict parking to one (1) vehicle total,  regardless of bedroom count. Please consult our website or your reservation agent to confirm the  maximum number allowed. Guest is responsible for confirming parking rules prior to arrival. 

Most condominiums and some homes prohibit boats, trailers, jet skis and motor homes and  oversized vehicles. Any vehicle not displaying required parking passes will be subject to being  towed, by the building or complex’s Homeowners Association or HOA, at the vehicle owners’  expense. Parking availability is not guaranteed, especially during peak season. Young’s Suncoast Vacation Rentals is not responsible for towing, citations, immobilization, vehicle  damage, HOA fines, or any fees assessed by the HOA, building management, or third-party towing  companies. 

4 – PROPERTY INFORMATION & MAINTENANCE 

4.1 Linens & Starter Supplies  

Linens and bath towels are provided; however, Guest must bring their own beach towels, as house  linens are not to be removed from the property. Towels, washcloths, and linens used to remove  makeup may become permanently stained. Guest may be charged for linens that are damaged  beyond normal wear.  

A complimentary “starter pack” of supplies is provided for arrival and includes:  • One (1) trash bag per trash can  

  • One (1) roll of toilet paper per bathroom  
  • One (1) roll of paper towels  
  • One (1) dishwasher detergent pod/tablet  
  • One (1) washing machine detergent 

Guest is responsible for any additional items and supplies needed during the stay. 

4.2 Maintenance of Rental Unit 

(a) Maintenance Issues 

Young’s Suncoast Vacation Rentals makes every effort to maintain each vacation rental in good  condition; however, the working condition of machines and equipment inside the specific rental

unit, including but not limited to air conditioners, cable/satellite, phones, Wi-Fi, televisions,  appliances, and other equipment, is not guaranteed.  

(b) Guest Responsibility to Report Concerns 

Guests agree to promptly notify Young’s Suncoast Vacation Rentals of any maintenance issue,  cleanliness concern, equipment malfunction, or other complaint during their stay by calling our  office at 251-968-7158, which is available 24 hours a day, 7 days a week. Guests agree to provide  Young’s Suncoast Vacation Rentals with a reasonable opportunity to inspect and, when possible,  correct the reported issue. 

(c) No Refund Policy for Maintenance Issues 

No refunds, credits, rate adjustments or compensation will be issued for concerns that are not  reported during the stay or for situations in which the Guest refuses or prevents Young’s Suncoast  Vacation Rentals or its authorized vendors from accessing the property to inspect or remedy the  reported issue. By remaining in the property without reporting concerns, Guest acknowledges  acceptance of the accommodations as provided.  

As outlined in Article 1, Section 1.4 of this agreement, any chargeback initiated for charges  authorized under this Agreement, or for concerns and complaints not reported to Young’s Suncoast  Vacation Rentals during your stay in accordance with this Agreement, will be in violation of this  Agreement and shall be considered a material breach of contract.  

4.3 Amenities 

The working conditions of common-area amenities that fall under the maintenance and  management of the buildings or neighborhoods’ Homeowners Associations (HOA) cannot be  guaranteed by Young’s Suncoast. These common-area amenities include, but are not limited to  pools, hot tubs, heated pools, elevators, common-area grills, and other related infrastructure.  

Some services and amenities, including internet and/or Wi-Fi service, and satellite or cable service,  may be managed by the HOA or third-party vendors. Young’s Suncoast cannot guarantee  uninterrupted service, availability, or performance.  

Young’s Suncoast cannot be held responsible for repairing or replacing common-area amenities or  equipment that is managed by the building, complex or neighborhood Homeowner’s Association  (HOA). 

No refunds, credits, or rate adjustments will be provided if common-area amenities, services, or  utilities become unavailable due to mechanical failure, service interruption, equipment  malfunction, maintenance, repairs, or other circumstances beyond Young’s Suncoast Vacation  Rental’s control.

4.4 Property & Owner Information 

(a) Right of Refusal 

All individual rental property; houses, condos, duplexes, townhomes, etc., are privately owned.  Young’s Suncoast is an AGENT of the property OWNER. We reserve the right to refund deposits,  refuse rental, or discontinue occupancy if in our judgment your occupancy is detrimental to the  property.  

(b) Individual Private Ownership 

Because all rental properties are individually and privately owned, decor, styles, color schemes and  furnishings will vary. There are no guarantees that the standards provided by the private individual  OWNER are compatible with those of the guest.  

(c) Furnishings 

Furnishings are subject to change without notice. All rental properties are equipped with central  heating and air conditioning, dishwasher, microwave, a basic television, and washer and dryer unless otherwise noted. Young’s Suncoast Vacation Rentals cannot guarantee the availability or  working conditions of these items, as outlined in this Article, Section 4.2(a)(b)(c)

(d) Property Information Changes 

Rates, availability, and property descriptions (including bed sizes, number of beds, and sleeping  arrangements) are subject to change without notice. Because vacation rentals are individually  owned, vacation property owners often make changes. As a result, furnishings, décor, and  household items may change at any time and may not exactly match photos. We make every effort  to ensure that all listing information remains accurate. Young’s Suncoast Vacation Rentals is not  responsible for errors or changes made by property owners, including changes to furnishings and  equipment. No refunds, credits, or rate adjustments will be provided due to changes in furnishings,  décor, or guest preference.  

5 – HOUSE RULES 

5.1 Guest Conduct  

Guests agree to comply with all rules, regulations, and notices posted at the Premises and/or  provided by Young’s Suncoast. Guest shall not, and shall ensure that all occupants and Invitees do  not: (i) disturb, annoy, endanger, or interfere with other guests, residents, neighbors, or the peaceful  enjoyment of the surrounding area; (ii) use the Premises for any commercial, business, or unlawful  purpose, including but not limited to the use, manufacture, sale, storage, or transportation of illicit  drugs or other contraband; (iii) host or permit parties, events, large gatherings, filming, photo  shoots, or any commercial activity of any kind without prior written approval; (iv) violate any  applicable law, ordinance, or regulation; or (v) commit waste or create a nuisance on or about the  Premises.

5.2 Parties 

(a) No Parties or Events 

All rentals are in residential communities and may not be used for weddings, receptions, parties,  events, or large gatherings. Any disruptive activity, excessive noise, or violation of occupancy rules  may result in immediate eviction and forfeiture of all rental amounts, with no refund.  

(b) Law Enforcement / Disturbances 

If the police or sheriff’s department is called to the property for any reason, including but not limited  to excessive noise, partying, domestic disputes, illegal drug activity, underage drinking, or  disorderly conduct, the Guest and all occupants will be immediately evicted. A $500 fine will be  assessed. No exceptions.  

5.3 Smoking Policy  

All properties are non-smoking. Smoking is strictly prohibited inside the property. Smoking is not  permitted on balconies. Any evidence of smoking (including odor, ashes, cigarette butts, burns, or  damage to furnishings) will result in a $500 fine. No exceptions.  

5.4 Pet Policy  

Pets are not permitted on the premises, even temporarily, unless the property is specifically  advertised as Dog-Friendly. Any evidence of an unauthorized pet (including pet hair, odor, urine  stains, or damage), or failure to notify the office in advance when bringing a pet to a Dog-Friendly  property, will result in a $500 fine.  

5.5 Service Animals  

Young’s Suncoast complies with all applicable ADA federal and state laws regarding service  animals. Guests who require a service animal must notify our office in advance.  

Emotional support animals, therapy animals, and companion animals are not permitted in non dog-friendly properties.  

Misrepresenting a pet as a service animal is unlawful and is a violation of this Rental Agreement.  Any Guest found to have falsified service animal status, provided fraudulent documentation, or  brought an undisclosed and unauthorized animal onto the premises may be subject to immediate  eviction, forfeiture of all rental payments with no refund, and additional charges including, but not  limited to, unauthorized pet fees, excessive cleaning charges, damage charges, and any fines  assessed by the HOA or Owner.

5.6 Fireworks  

The use of fireworks is strictly prohibited at all vacation rental properties. Local city ordinances and  fire codes prohibit fireworks on beaches, buildings, and grounds.  

5.7 HVAC Guidelines 

Guest agrees not to leave windows or doors open while the air conditioner is running, as this can  cause the HVAC system to freeze and malfunction. Guests will be responsible for any service calls,  repairs, and excessive utility charges resulting from misuse. During summer months, do not set the  air conditioner below 72°F. If the unit freezes due to extreme temperature settings, Guest will be  charged for all associated repair costs and excessive utility usage.  

5.8 Plumbing  

(a) Commode /Toilet Use 

Do not flush feminine products, wipes, paper towels, or any foreign objects. If a clog occurs, a  plunger is provided for Guest use. Guests may be responsible for plumbing service calls caused by  improper use.  

(b) Drains & Kitchen Disposal Use 

Do not pour grease or cooking oil down any sink or drain. Do not place shellfish waste (including  shrimp shells, crab shells, etc.) or other hard food waste into the garbage disposal. Guests may be  responsible for service calls caused by misuse.  

5.9 Pool & Hot Tub Rules  

Guests are required to follow all posted pool and hot tub rules posted by the building, complex  and/or HOA. These rules are typically posted in the pool and hot tub areas and must be observed at  all times.  

5.10 Grilling  

Fire department regulations prohibit the use of grills on decks, porches, and balconies at all  condominiums, beach houses, and duplex properties. Most buildings and homes provide  designated community BBQ/grilling areas for Guest use.  

Guests must never dispose of hot coal, ashes, or charcoal in trash cans or plastic containers. All  coal and ashes must be completely extinguished and cooled prior to disposal. 

Any condos with built-in gas grills located on the balconies are exceptions to the Grilling Policy.  Guests must follow all posted grilling rules and use grills safely at all times.

5.11 Homeowner Associations (HOA)  

Many vacation rentals are located within condominiums with homeowner associations (HOAs),  which periodically schedule maintenance, repairs, inspections, construction projects, or  temporary amenity closures. Certain properties may also be subject to HOA-specific rules,  regulations, or restrictions that Guests are required to follow. 

Young’s Suncoast Vacation Rentals will make every effort to communicate any property-specific  notices, HOA disclaimers, construction information, amenity closures, or applicable rules that  have been provided to us prior to your arrival. However, Young’s Suncoast Vacation Rentals is not  affiliated with or responsible for the management of the HOA and may not receive advance notice  of all maintenance, construction projects, inspections, amenity closures, rule changes, or other  HOA activities. In some cases, projects or restrictions may begin or change after this Rental  Agreement is executed or after your arrival. The absence of information does not guarantee that no  such work, closures, or restrictions exist. Any property-specific information currently available to  Young’s Suncoast Vacation Rentals will be provided, when possible and applicable. 

6 – ACCESS TO PROPERTY 

6.1 Young’s Suncoast Vacation Rentals Access 

From time to time, it may be necessary for Young’s Suncoast Vacation Rental’s staff,  representatives, or authorized vendors to enter the property to confirm compliance with this  Agreement, to provide maintenance, repairs, or other services, or in the event of an emergency.  

6.2 Owner Access  

The Owner and/or the Owner’s authorized representatives may also need access, with reasonable  notice, to show the property to prospective or actual purchasers, tenants, lenders, appraisers, or  contractors.  

6.3 Notice of Access 

When possible, Young’s Suncoast Vacation Rentals will make every effort to provide advance notice prior to entry. However, urgent repairs, vendor scheduling, HOA requirements, or  emergencies may require entry without prior notice. 

7 – LIABILITY & LEGAL 

7.1 Limitation of Liability 

To the maximum extent permitted by law, the Owner and Owner’s agent, Young’s Suncoast Realty &  Vacation Rentals (“Young’s Suncoast”), shall not be liable for any loss, theft, or damage to Guest’s

personal property, including items left behind, and do not assume any duty to provide security for  the Premises.  

7.2 Assumption of Risk 

The Guest and all Occupants and Invitees use the Premises and all amenities at their own risk.  Guest acknowledges that use of any pool, hot tub, dock, pier, boat slip, boat lift, marina access,  waterfront area, or any water-related feature is inherently dangerous and may result in serious  injury or death. No lifeguard is provided. Guest is always solely responsible for supervision of all  children and non-swimmers.  

7.3 Disclaimer of Warranties 

No warranties, express or implied, are made regarding the condition, suitability, or uninterrupted  operation of the property, utilities, appliances, or amenities, and no refunds or credits will be issued  due to mechanical failure, service interruption, or amenity downtime.  

7.4 Indemnification 

Young’s Suncoast and the Owner are not liable for allergic reactions or health-related issues arising  from environmental conditions, including but not limited to mold, airborne spores, pet/animal  allergens, chemicals, furnishings, linens, carpeting, hot tubs, grills, or other equipment. Guest  agrees to defend, indemnify, and hold harmless Young’s Suncoast Vacation Rentals and the Owner,  including their employees, agents, and vendors, from any and all claims, damages, losses,  liabilities, costs, or expenses, including reasonable attorney’s fees arising out of or related to  Guest’s stay, use of the Premises, use of any pool, hot tub, dock, pier, boat slip, boat lift, or  waterfront area, or the actions of Guest, Occupants, or Invitees. If Young’s Suncoast and/or the  Owner engages legal counsel or a collection service to enforce this Rental Agreement or collect  amounts due, Guest shall be responsible for all costs of enforcement and collection, including  court costs and reasonable attorney’s fees. Failure to enforce any provision of this Rental  Agreement shall not be deemed a waiver. This Rental Agreement shall be governed by the laws of  the State of Alabama, and any legal action arising from this Rental Agreement shall be brought  exclusively in Alabama courts. If any provision of this Rental Agreement is held unenforceable, the  remaining provisions shall remain in full force and effect. This Rental Agreement contains the entire  agreement between the parties and may only be modified in writing (including electronic execution  where permitted). 

8 – PRIVACY & COMMUNICATIONS 

8.1 Information Collected 

(a) Personal Information Collected 

By booking a reservation at any Young’s Suncoast Vacation Rentals managed property, you agree  that AGENT will collect information from you to ensure the adequate performance of contracts

between you and Young’s Suncoast Vacation Rentals. The provision of this information is  necessary, and without it, AGENT will not be able to provide you with the services that you request. 

(b) Property Inquiry and Booking request 

When you submit a property inquiry or request to book accommodation, we require certain  information such as your name, phone number, and email address. 

(c) Payment Information 

When you book accommodation through Young’s Suncoast Vacation Rentals, we collect the  necessary billing and payment information to process your reservation. Payment information is  securely processed and stored through our reservation management and payment processing  systems. Young’s Suncoast Vacation Rentals maintains compliance with the Payment Card  Industry Data Security Standard (PCI DSS), and sensitive payment information is encrypted to help  protect your data. 

8.2 Communications 

When you communicate with Young’s Suncoast Vacation Rentals, we collect information about  your communication and any information you choose to provide. 

(a) How We Use Your Information to Communicate 

The list of purposes/activities below sets out how we process your information and the lawful basis  for the processing of such including communicating with you via email, phone call, SMS text  messaging, or web chat features: 

  • When we assist you with booking accommodation. 
  • When you seek to amend or change a booking or make an inquiry in relation to a booking. 

(b) Managing Our Relationship with You 

To manage our relationship with you, communication reasons may include:  Notifying you about changes to terms, rates, or other notices. 

  • Notifying you about changes to your accommodation. 
  • Sending relevant check-in (arrival) and check-out (departure) instructions and other  relevant reservation information to you. 
  • To send marketing or other promotional communications to you.

9 – GENERAL PROVISIONS 

9.1 Fair Housing 

All units are rented in compliance with all applicable fair housing laws and are offered without  regard to race, color, religion, sex, national origin, disability, familial status, or any other protected  class. 

9.2 Property Preview Disclaimer 

Due to liability issues, Young’s Suncoast Vacation Rentals is unable to provide prospective renters  with keys or entry access to preview properties.

Taxes and fees are subject to change without notice.
